1. Overview of Services
We provide access to curated and parsed materials from the U.S. Food and Drug Administration (FDA), including but not limited to:
- 510k summaries
- Medical device registries
- FDA Adverse Event Reporting System (FAERS)
- Manufacturer and User Facility Device Experience (MAUDE)
- Incident reports
- Recalls
These materials are presented in a user-friendly format and are updated regularly to assist medical professionals, researchers, and industry stakeholders in their decision-making processes.
2. Subscription Plans
We offer a monthly subscription plan for access to our content and services. By purchasing a subscription, you agree to the recurring billing associated with the plan, which will be charged to the payment method you provide upon signing up.
We reserve the right to modify our pricing and will provide notice of any changes. Subscription fee adjustments will take effect in the billing cycle following notice.
3. Free Trial
We offer a 7-day free trial for new subscribers. The trial period begins upon sign-up and allows you full access to our materials. To avoid being charged for a subscription after the trial period, you must cancel before the end of the 7-day trial.
If you do not cancel within the trial period, you will be automatically enrolled in our monthly subscription, and the payment method you provided will be charged.
4. Payment Terms
Your subscription is billed on a recurring monthly basis. Upon signing up, you authorize us to charge your payment method for the monthly subscription fee at the beginning of each billing cycle.
Billing Date: Your billing cycle will begin on the day following the end of the 7-day free trial or, for existing customers, the date of your initial subscription. The billing cycle will recur every 30 days thereafter.
You must provide accurate and current payment information. If payment fails or is not received, we may suspend or terminate your access to the service until the outstanding balance is resolved.
5. Cancellation and Refund Policy
Free Trial: You may cancel at any time during the 7-day trial period without incurring any charges.
Subscription: You may cancel your subscription at any time. Upon cancellation, you will continue to have access to our services until the end of your current billing cycle. We do not provide refunds or credits for partial months or unused services.
To cancel your subscription, you can use the linkn from your home page of your USER account found at https://www.mibio.io/account/my-account. If you do not have acess to this page, please email us at info@mibiomed.org with the SUBJECT "Cancelation Request". After cancellation, your subscription will not renew, and no further charges will be made.
6. Changes to Services
We reserve the right to update or modify the materials we offer or the structure of our services at any time. We will make every effort to notify subscribers of any significant changes. Continued use of the service after such updates signifies your agreement to the changes.
7. User Responsibilities
By using our services, you agree to:
- Use the information provided solely for lawful purposes.
- Not redistribute, share, or publish our content without prior written consent.
- Comply with all applicable laws and regulations related to the use of FDA data and medical device reporting.
8. Intellectual Property Rights
The curated and parsed content provided through our service remains the intellectual property of Mibio Medical and our relevant content licensors. You are granted a limited, non-transferable license to access and view the content for personal or professional use.
You agree not to:
- Modify, copy, distribute, or create derivative works from the content.
- Use any automated tools or bots to scrape data from our platform.
- Reverse engineer or use methods that could compromise intellectual property and/or trade secrets of ours.
9. Limitation of Liability
The information provided through our service is derived from publicly available FDA data, which may not always be complete, accurate, or up to date. We do not warrant the accuracy or completeness of this information and recommend using it in conjunction with other sources.
We are not liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our service.
10. Termination of Services
We reserve the right to suspend or terminate your access to our services at any time for any reason, including, but not limited to, violation of these Terms. Upon termination, you will not be entitled to any refunds for the remaining portion of the billing cycle.
